You left the part out where he cited a specific instance: "Just 29 days ago, a criminal alien freed by the sanctuary city of New York was charged with the brutal rape and murder of a 92-year-old woman. The killer had been previously arrested for assault... he was set free." As to the known traveler programs, this situation was brought on by governor Cuomo when he gave illegal aliens driver's licenses. The known traveler issue is relatively small. It may affect tens of thousands. Because of Cuomo's reckless decision, millions of Americans - everyone who has driver's licenses - will be affected. Because non citizens can get them, New York driver's licenses will no longer be considered valid for boarding domestic flights. If you want a license that can be used to get an airplane you now have to provide to the DMV that you are a citizen - even though prior to this reckless decision, you already had to prove you were a citizen to get the license in the first place. Illegal aliens get a driver's license. Citizens have to prove they're legal. Doesn't make sense. Cuomo has put the convenience of illegal aliens ahead of the American citizens he was elected to serve. A NY license also includes automatic voter registration. Something to be seriously looked at.

Since then, the program has spread widely. President G.H.W. Bush even singled it out as one of his "thousand points of light". But I get what you're saying. My specific hope, however, is that the NYT editors might take a lesson in diction from Ms. James. Trump's speech as well as his action is not accurately described as "combative." It's much more accurate to call it "authoritarian" and "thuggish." As of February 6, 2020, it seems certain that it's going to get more authoritarian and thuggish, and fast. The editors need to keep up.

In one sense, this is an admission by the President that his own agencies are so incompetently run and inept at their jobs, that they cannot independently vet American citizens. That is the bigger issue here. The total incompetence of the administration's ability to actually run government agencies, and have them do their jobs, that they were competently executing before Trump took office. The Democrat controlled state government in Albany, lead by Cuomo, brought this measure by the federal government on themselves, and the citizens of New York. Allowing illegal aliens to obtain drivers' licenses, and then restricting federal government access to the DMV databases on all drivers left the federal government with no recourse except to retaliate with force. Consequently the travelers residing in New York will pay the price of the actions of their own state government. Meanwhile have you been to a DMV office lately? The long lines for licenses will amaze you, and it will simultaneously show you just how many illegal aliens reside in our state.

And while I don't personally like Trump's TV personality and he appears to be lacking intellectually, I am backing him and the GOP 100%. I find the consistent attempt to legitimize illegal residents by giving them drivers' licenses repugnant. Add to that moves to permit them to vote in local elections, under the assumption they will create bulletproof Democratic majorities. I applaud the Administration's policy, however it is perceived, and however it may inconvenience me and the many(but nowhere near enough) other Trump supporters in NYS and CA.

I am disgusted by this country, whose citizens are apparently rallying around a corrupt, vengeful charlatan who is on the take. Scores of people are hooked on opioids and others are going broke on farms or incarcerated, with racial overtones. Russia is taking over our elections, while Republicans feed us the convenient conspiracy theory that it’s actually the Ukraine. Or that Trump did nothing wrong. Meanwhile, people believe the string of lies he makes at his rallies or state of the union. And they embrace the myth that the economy is booming. It is, for the rich. I am not hopeful.

You don’t need a driver’s license for TTP Programs or a record in a state DMV database at all to qualify for them. The information being withheld is irrelevant to the program as undocumented immigrants in general cannot apply for these programs. Withholding these travel privileges because of unrelated political differences hurts people like NY small business owners who have businesses that trade with Canada. Longer border lines restrict trade and prevent quick access to markets to name just one of the unnecessary impediments to travel this is creating.

I knew the moment that the cowards in the Republican Senate delivered their acquittal of Trump with their sham trial in front of the Chief Justice of the United States, that Trump would start his rampage of revenge against the defenders of the Constitution and decent people who have empathy for others over "trumped" up charges. These same techniques were used by the Nazi's in the 1930's and are being used currently by Putin to suppress his adversaries. Trump's revenge tactics have been taken from the textbook of dictators and fascists.

We disagree with state policies that grant non-citizens, and certainly people who don’t have authorized permanent residency in the country, the same driver licenses /state-issued identification as US citizens and, perhaps, authorized permanent residents. Particularly since, in many instances and practically speaking, it is those documents that end up being used in lieu of a national identification for determining all sorts of rights, privileges, and responsibilities of bona fide US citizens. Our friends who are in the U.S. but who don’t have U.S. citizenship could easily have their driving skills and knowledge of U.S. and state motor vehicle law tested and certified to drive on our roads (ie, the purpose of a DL) and/or be recognized as being a resident of a given state by applying for and receiving a color- or otherwise-coded card from that issued to citizens. It would be similar to how many countries grant a different colored passport to long-lost expats from their nation who after years off the proverbial radar and who, having aged and changed in appearance, now seek repatriation or a passport but cannot immediately establish that they are who they say they are (ad we have seen happen). All that said, it is wrong, and likely illegal / unconstitutional for all of the residents, including the majority who are undoubtedly US citizens, to be singled out and denied something important because of the wrong-doing of only some, all of the latter being non-citizens.

Our only hope is that New York's attorney general will fight for rights of our state, that we can indeed pass our own laws in defiance of these federal restrictions which will no doubt spread not only to sanctuary cities but to the entire country if left unchecked.

Trump is also attacking the survivors of the 2018 inferno in Paradise, California, and the 2017 wildfires in the Bay Area. It is ironic that a lot of Trumpers used to live in Paradise, which is in a more conservative part of California. So the Trump administration is mainly hurting its own. PG&E, the utility in Northern California, has admitted liability and has also offered approximately 14 billion to settle claims by wildfire victims. However, for the first time in its history, FEMA is demanding a large part of the victims' settlement, claiming it must be reimbursed for its disaster assistance efforts. This, despite the fact that many of the Paradise fire victims were uninsured, and most of the victims of all of the wildfires were underinsured. FEMA granted no assistance funds to numerous victims of the wildfires. This was especially true of Paradise. So victims who received no financial support from FEMA, for whatever reason, are being asked to give up part of their claim against PG&E to reimbursed FEMA. The victims' lawyers are battling FEMA in the bankruptcy court. At the least, they are asking that FEMA's reimbursement come from a settlement fund other than the victims'. This punitive action by FEMA is apparently aimed at California, since such reimbursement has never before been attempted.

This may be a blessing in disguise. The public does not get too upset if Trump takes autocratic steps that don't effect them personally. The "Quid pro Quo" with Ukraine, hollowing out the Departments of State, or Justice, or his verbal assault on the media, the FBI, CIA, and "Deep State" don't harm most people. But attacking citizens of blue states directly, which also harms Republicans in those states, does harm people directly. More importantly, people in those states will see that they have been targeted for revenge by Trump. (Capping the SALT tax deduction was an attack on citizens of CA, NY, and NJ but the Democrats never emphasized that.) That could create a backlash. People get mad when they're targeted. Angry people vote.

There was an early indicator of this sort of blowback with tax reform. The so-called SALT cap - where previously unlimited deductions are now max'd out at $10k. Now if you live in a Red state w/ low real estate values, this may not mean much to you; but, if you live in a Blue State (that did not go for T in the 2016 election), your real estate and other deductions have been > $10k since pretty much forever. This SALT cap hits hard, right where it counts. Any tax professional worth their salt (pun intended) will admit this is basically payback for not going with t in the election. As for GOES, it can be expected that California and other states will soon join NY on that list of non-renewal to the program. CA has Sanctuary cities as well. Haven't any stats to back this up, but it can be expected that people in Blue states travel internationally in greater numbers than Red states. Likely the program means more to Blue states than Red. Can we expect more of these sorts of seemingly petty but important paybacks from this admin? It's who he is. In his blood. He has been given the green light to do as he pleases. And thus he shall punish as it pleases.

I deeply loathe Trump and all he stands for. But I am somewhat confused by the reporting on the Global Entry program. As I understand it, the element of the New York law that DHS has focused on is the prohibition of access to the New York DMV database without a court order. I am a native-born U.S. citizen with a U.S. passport. While I have never been a New York resident or held a New York driver's license, my New York driving record was highly relevant to my Global Entry approval process. In 1990, I received two speeding tickets within a short period of time at "speed traps" in northern New York State. At my Global Entry interview in 2013, the CBP officer quizzed me extensively on these speeding tickets, and told me that they showed "disrespect for the law." While I was granted Global Entry, there was initially some kind of limitation placed on my membership because of these infractions. So based on my personal experience, DHS access to New York State driving records is in fact relevant to the approval process. That said, I would think that a workaround to the New York legislation could be devised to permit access to DMV records for the limited purpose of Trusted Traveler programs (to which no sane undocumented person would ever apply anyway).

It’s highly political on both sides. If Obama was president, the green light law probably wouldn’t have included the ban on access to the DMV database. There are two fundamental issues at stake here that our legislative branch hasn’t resolved: 1) comprehensive immigration reform and; 2) privacy. Until those two are widely discussed and modern approach prevails, we’ll keep seeing polarization in situations like this. Trump administration is determined to hurt New Yorkers and they can. So here’s where politics should be at work: I think providing driver’s license to undocumented should remain, but banning access to DMV should be reversed. Unfortunately, Trump might be president for 4 more years, so politicians need to be more pragmatic and learn how to deal with them without unnecessarily hurting New Yorkers.

Trump, like many Americans, does not understand what a "sanctuary" city mean. It does not mean that an undocumented immigrant is suddenly a "legal" immigrant. It merely means that local police or other government officials will not assist ICE in detentions or notify them. It means that an undocumented person can feel free to report a crime or other violation without fear of being punished for their immigration status. It makes a community safer.

This directive seems to be totally unconstitutional violating both Article I Section 9 that ensures all ports of entry must be treated equally, and Amendment 14 guaranteeing equal protection under the law. Punishing the citizens of a state individually in a Federal act also violates the spirit of the Constitution. While punishing state governments is one thing, even when it affects the individual citizens, but specifically barring citizens from Global Entry simply for being residents of a particular state is no different than denying them passports for that reason, which, I'm betting, is next on Trump's list of retributions. I urge NY AG James to IMMEDIATELY file for an injunction and TRO to block this policy and fast-track it to the SCOTUS for review.

The problem with most sanctuary cities and states, is they treat aliens better than ordinary citizens. Charges are dropped, or reduced to avoid deportation. No auto insurance, no problem. In most states, they write a ticket, then they tow your car. No insurance, no getting the car back. Some judges are helping defendants sneak out a basement door to avoid arrest by ICE agents. These cities and states are creating laws to obstruct federal agents. Why wouldn’t the Federal Government retaliate appropriately?

Frankly, this is fine. I am perfectly OK with Republicans setting the precedent where a President actively attempts to harm states that don't fall into line with his policies. I am reading Laurence Rees The Holocaust: A New History. In the section covering Germany from 1933 to 1938, I am finding too many frightening parallels to our time. That's happened more than once in the USA, and also in Canada, Australia, etc. Eventually, most of those exclusionary rules were rescinded, only to be replaced with new ones. Bottom line: "If you're not here leaglly" is and always has been a moving target. It's a convenient way of avoiding theh ethical and moral questions around keeping people out.

New York has no power to remove illegal aliens. And Trump, for all his noise and bluster, hasn’t deported all that many, either. Sadly, he has chosen to focus on those best integrated, those who registered with Immigration and showed up annually to report their whereabouts, people who’ve been here for decades, people with families, causing no trouble whatever. Instead of deporting criminals, ICE lies in wait at courthouses to arrest people honoring their legal obligations. The fact that Trump hasn’t solved the immigration problem — or even seriously tried — is proof he and Republican politicians generally don’t want to solve it. They prefer collecting votes from people like you who want the problem solved, and who don’t understand the problem is useful only while it still exists. If they fixed it, would you keep voting for them out of gratitude? Meanwhile, it’s not a problem. Illegal aliens are indistinguishable from legal aliens in most ways. They uprooted their lives and left family behind, seeking a better life here. Why not let them stay? Contra your assertion, they pay taxes. They’re funding schools and roads and social security and welfare as much as anyone. Make them legal noncitizen residents, and turn the page.

But it will definitely be something designed to inflict pain on the people of California. There is a clause that qualifies his promise to protect, etc. the Constitution. The problem is not just the man at the top - it is the fever he induces in almost half of the population. It’s probably not a “federal crime” because Congress doesn’t generally pass laws that virtually no one can break. Only Trump can issue “Executive Orders.” The mechanism for policing that power is impeachment, which requires no crime to be committed. Your example highlights WHY impeachment doesn’t require proving a violation of any statute.

Trump lived in New York most of his life; so he’s left a paper trail a mile wide, not to mention phone calls, video tape, photographs, and interactions with thousands of people. Somewhere in all that pile is OPPOSITION RESEARCH GOLD—information or images that could really damage Trump’s carefully crafted image. I know Trump looks invincible now; but almost every tyrant or army or political system looks invincible—until they’re not. (Remember the Soviet Union?) It’s like a balloon; one weak spot, one encounter with a very small pin, and the air leaks out, possibly very suddenly. (Better yet, of course, lots of small pins, or a few big ones.) So, New Yorkers, there’s probably something you already know that, turned over to the Times (or the New York Post, Politico, even People Magazine) could put a conspicuous hole in Trump’s balloon. Down here in the DMV, we’re doing our best to dig up dirt; but Trump is a very recent transplant to Washington. You New Yorkers have a much better chance of finding something relevant. California ranks just as high, I think. In fact, it's the great monster that threatens Trump the most. California's voters are too numerous to let him win the popular vote. The NYT and its readers romanticize the idea of illegal immigration, refusing to accept that 2 things. 1. A few illegal immigrants are charming and worth protecting, but when MILLIONS are gaming the system, taking advantage of the American generosity, as it happens, there is a national and state problem (for schools, ER rooms, driving, etc). 2. Not all illegal immigrants are perfect citizens. A good percentage of them are not. Assuming, for the sake of argument, that just 1 percent of these millions are bad, the Democrats and the NYT make the value judgment that the lives of some American citizens are worth losing and risking for the sake of importing million unvetted people. I am uncomfortable with this value judgment, and I don't think the Democrats and the NYT should decide something like this for me only because in the major cities the Democrats win by default and practically we live under a one-party system.

Yeah well, guess what. I'm a New Yorker, and while I've never bothered to use this 'trusted traveler program' thing, Trump is first on my revenge list. Him, and all those who support him. I will be opposed to trumpism for the rest of my life, and will never miss an opportunity to say bad things about him (although here on the NYT pages, 70% of those things will be blocked). So fine, he wants to make travel for me tougher, I will do my best to make sure he is never welcome in NYC again. After he's president, he should find some other place to retire, because I'm going to make certain he would not feel comfortable here. Same goes for all his supporters. I'm happy to help a tourist with directions, but if they're wearing a red MAGA hat, they're lucky if I pass by them without comment. Customs and Border Protection conducts rigorous background checks on all Trusted Traveler Program applicants. The background checks are what gives some travelers trusted traveler status. CPB relied on its access to New York DMV records to screen New York applicants. New York’s new Driver's License Access and Privacy Act precludes this. New York needs to modify the act to allow CPB access to DMV records of New Yorkers who apply for the Trusted Traveler Program. New Yorkers who value their privacy over expedited passage through airport secret and immigration can stand in line with the rest of us.

"If you live in the state, you won’t be able to enroll in Trusted Traveler Programs." I know that Trump is ultimately responsible for decisions like this. But the complexity of this one is obviously beyond his ability to think up on his own. And it is so petty and irrational that it clearly had to come from his anti-immigration czar, Stephen Miller. This will be an inconvenience for some, but a very few, really. I've travelled through NYC airports recently, and the check-in lines aren't the real aggravation there. They move quickly enough. It's the traffic getting to and from the airports that's the real problem. Gads, what a nightmare THAT is. I don't know how even Trump could make that worse. And I won't even mention LaGuardia.

This is bad enough but one can see a very frightening trend. Trump's base are concentrated and now have little concern for the rest of the country. Indeed, they may be hostile to it. Trump can control the government with this small minority as long as he and members of his party are willing to break the law. If he cannot gain popularity or respect in certain regions, he will use fear. However, I would not be surprised if he finds some way to get special dispensation for his supporters in NY. In fact, he'll probably charge them for it in the form of campaign donations. If he is re-elected there's no reason for him to try to govern with the interests of the public in mind, and a lot of reason for him to use fear against whomever he likes. And he benefits by fomenting regional divisions. I already see people playing along by attacking people from 'red states' which is absurd. When you apply for Global Entry, you sign away almost all restrictions on Customs looking for problems in your records. Yes, you have to have a passport to start the process, but that is just the beginning. Passports don’t have addresses, they do not have traffic records or name changes or even minor things like Veteran status. Probably info could be scooped up in many places, but DMV records are large foundation point in the review process. Global Entry means you scan your passport, provide a fingerprint and wave to the Customs agent as you enter the country. As noted, it is a privilege. If you are not completely squeaky clean, the right answer is disapproved. Then you wait in line with everyone else.

There seem to be a great number of comments from people who have little understanding of our federal government. So, let's get a few things straight. First, New York is a sovereign state, one of fifty. It is not a province or a territory, and its people elect their own representatives to enact laws to protect their own safety. Second, our national government is one of limited enumerated powers with strict limitations. Thus, under our national constitution, the citizens of any one state may not be deprived of any privilege available to the citizens of the several states (see, Art. IV, Sec. 2). Trump's revenge scheme is therefore yet another violation of the foundational law of the land. Third, New York has made a choice to safeguard its population, by ensuring that undocumented immigrants (and citizens and residents) cooperate with law enforcement and state authorities. As a result, New York enjoys historic low crime rates. As a result, New York is also a world center of commerce, education, culture, civilization and human development -- whilst our country cousins feel free to bring their machine guns to their state capitols. Here endeth the lesson.

The Constitution grants the national government total authority over processes that manage movement across national borders. A state may pursue its own interests for its citizens, but when conflicts occur at the border, the Feds win. For the same reason, you have to have the Real ID star on your license, something NY cannot put on any license except for citizens and foreigners with legal status. Anyone will still be able to look at a license and know immediately the person’s immigration status.

The constitution does not vest the federal government with general police powers, and the federal government cannot direct any state to use state resources to enforce federal law. And, again, depriving the citizens of any one state of privileges enjoyed by the citizens of the other states violates the constitution. So, in this instance, the national government (led by a criminal) is violating the fundamental law of the land.

I can almost, but not entirely, understand the concern about TSA Pre-check. If one has to use a driver’s license to go through airport security, it makes sense to verify the traveler’s identity. Global Entry is another matter - it can’t be used without a valid passport. In this case, the Trump administration’s new directive against New Yorkers makes absolutely no sense, except as a vindictive measure. One wonders if it will be expanded to include citizens of other states with Green Light laws

Folks are protesting in Brooklyn because of a tragic shooting of a family member of a deportee by ICE. The person being arrested was removed twice before. Respect for Rule of Law and better border enforcement will help prevent tragedies like this. Tolerating disrespect for the law invites further disrespect. First, I think that barring New Yorkers from Trusted Travelers programs is transparently vindictive, and will benefit no one. That said, the position of the left on illegal immigration which results in sanctuary cities and the Green Light Law, set against their rhetoric about the threat Donald Trump presents to the rule of law is transparently hypocritical. In a representative democracy, some shreds of which still remain in our country, if one does not believe in a law, one attempts to convince a majority of one's fellow citizens to support candidates who will change the law. If one cannot garner that majority, then the law stands. Then, either one believes in the rule of law or one doesn't. Does one follow the laws one likes and ignore the rest of them. Is that not the great (and legitimate) complaint about President Trump? And is that not the very definition of corruption? Why would immigration laws be less valid that those concerning campaign finance? Personally, I have compassion for people fleeing to the United States from corrupt, failed nations. But the main reason that the U.S. is attractive to them is that it is comparatively stable and therefore prosperous precisely because of the greater (not perfect) rule of law, rather than the petty tyranny of a dictator. Illegal immigrants do not understand that. The problem with the "undocumented" is that their very first act here was to break the law, no matter their other virtues. The average voter understands that.

New York’s sanctuary state laws will therefore be stricken down as an impermissible interference with something that is solely within the federal government’s prerogative. I am sorry, but as a New Yorker, I find the request of Homeland Security to be able to look into the DMV files to be quite sensible. I also disagree with allowing illegal immigrants to get driver licenses. It is an incentive and a magnet for more illegal immigration. Already, about half of the nonoffice jobs in NYC are held by illegal immigrants, which puts at a disadvantage legal immigrants and native Americans. I am a legal immigrant and when I first looked for a job in NYC, in a bag store on Madison Avenue for minimum wage, I was fired after a week and replaced with an illegal immigrant who worked for half the minimum wage. The story continued, in Manhattan restaurants and so forth, until I escaped to an office job where there was scrutiny. It makes no sense to spend trillions abroad fighting terrorism when every foreigner can sneak illegally into the US and be shielded of any scrutiny.

POTUS has been clear from Day 1 that he wants sanctuary laws struck down There are multiple lawsuits winding their way to an eventual decision by SCOTUS. If their precedent of holding POTUS on visa bans etc - based on finding that he alone can execute immigration laws and deserves a wide latitude - sanctuary laws will be struck down. This is an election year - and POTUS thinks railing against sanctuary laws are a winning argument. After he is reelected in November - he may have a better political standing against sanctuary laws. And folks - remember, there are many localities that are strongly opposed to this issuance of driver's license. I have one of these global entries, I, for one think - he must ensure that the program is not corrupted.

Politics can be messy and dangerous. As in every power shift, coup or revolt, the loser should always expect retribution. This is a prime example of that. Without drawing sides, were Cuomo not a governor of NY but say Oklahoma, his rhetoric and combativeness would be non-existent. NY and Cali must and can afford to fight the federal government, to a point. Their huge population virtually dictates a more liberal governance, unlike the rest of the country. In the end, fighting with Trump will be to the detriment of Cuomo and NY. Should Trump be reelected, another 4 years of this discord will come at a huge price to NY. Frankly, were I Trump, given the whole unsavory history with NY I might just do the same. Let the winner take the spoils.

Don't forget that the tax-cut-for-the-rich included provisions designed specifically to punish the residents of blue states by compelling them to pay more in taxes. As a consequence in those states it is not uncommon for residents to now pay several thousand dollars in extra taxes. Some folks are paying as much as ten thousand dollars more. Given that the blue states already pay much more per capita than the red states, and subsidize the red states, this is a hard pill to swallow. Undoing the tax-cut-for-the-rich should be at the top of the Democratic candidates' to-do lists.

The number of people who benefited from the higher standard exemption - in NYS as well as in the whole country - far outweighed those who are now paying higher taxes due to the SALT being capped at $10,000. We are struggling to make ends meet in our middle class jobs in education, even at the peak of our careers when you would think the starter home deprivations would be long behind. It’s completely fabricated. There isn’t anything in the drivers’ license database that needs to be shown to get a global entry card. A passport and birth certificate prove citizenship, age etc and tax and utility bills prove residency. Can NY sue? Can we block Global Entry for anyone landing in a NY State airport regardless of residency? If no one could use their fast entry ID’s at JFK etc my guess is thevDHS would back down.

@Alexandra Hamilton The Global entry program is not just for US Citizens. Lawful permanent residents and citizens of some countries, including Canada and Mexico are eligible. Applicants who have a conviction or pending charges for any criminal offence including DUI are not eligible.

So how long will New York State subject itself to a foreign tyranny? NYPD has 40,000 men under arms to start, who are loyal to whoever pays them, and that ain’t Trump. That’s the equivalent of a heavy armored corps. New York also has 10th Mountain at Fort Drum, West Point, the best harbor on the East Coast, and a long border with a friendly foreign power. If the New England states join New York, a massive chunk of tax revenue will no longer flow into a federal government that is already $1 trillion in deficit this year. Should California, Oregon, and Washington leave simultaneously, the United States would be financially unsustainable without massive tax increases to the remaining states. That should pull the Mountain West, Pennsylvania, Maryland, Virginia, Delaware, and North Carolina into secession. Then if Texas declares independence over the tax burden, Trump will be finally left with only the Red rump states, and their citizens will have the President that they so richly deserve.

I (a Pennsylvania resident) have an appointment to finalize my application this Saturday. It was made clear during the application process that I was authorizing an exhaustive background check. That is the point of the application; to submit yourself to scrutiny as a potential security risk. The provision blocking federal immigration agents from retrieving information from the New York's D.M.V.’s databases without a court order, is in no way an obstacle to that background check authorized by every applicant. Trump's action is punitive, mean-spirited, and poorly thought out.

Participants in Global Entry are allowed to enter the United States with gentler evaluation at the border than non-members. The program was, until now, open to all citizens, as well as citizens from 9 foreign countries that provide the information needed for background checks. The rationale for such facilitated entry is simple and based on common sense; membership in Global Entry requires pre-screening and a background check. A major component of pre-screening is evaluation of drivers license records. New York State is refusing to allow the Federal government access to the state's drivers license records, so a thorough screening of New Yorker's is not possible. If NY permits the government access to these records, the restriction will be lifted. This doesn't sound like it's about a vendetta by the Administration, it sounds like common sense. Bad people do enter the country - remember 9/11. It's the governments obligation to take reasonable measures to prevent the entry of would-be terrorists. They are simply doing their job. If NYS refuses to allow Homeland Security access to all NYS drivers license records, I would think they can implement a process to to state residents who desire Global Entry to opt out of the restriction, and for the state to provide access to the the records of these individuals.

Alex, the opt-out is the application itself. You authorize any necessary inquiries. That's why this makes no sense. If you apply (as I did), you authorize the DHS to do a thorough background check (state driver's license information included).

Yes, but NYS is not allowing DHS to access the DMV’s drivers license database so they are making the system ineffective for NYS residents. NYS can do what it wants and NYS residents have other means for enhanced entry, its just not going to be by using just a NYS driver’s license.

Oh, and @Alex, you mention a concern about “bad people”. Having been in NYC and lost friends on 9/11, I can tell you that I worry a heck of a lot more about a “bad” person driving around without insurance and injuring me or someone I love than some terrorist thinking it’s a good idea to try to gain Global Entry clearance (cause aren’t, like, all terrorists are lining up for invasive background checks...?) And if you’re so concerned about our borders integrity, shouldn’t we want more people pre-checked and out of the way upon re-entry so that ICE and Border Patrol can devote their focus to screening the ones that haven’t passed rigorous background checks? I’d rather have that one customs agent screening hundreds because the bulk of people are able to zip through Global Entry vs having him or her have to screen thousands because some tiny little dictator wanted to flex his flabby muscle and prevent people from getting Trusted Traveler status (with or without a NY State drivers license!)

It truly is scary to see how Trump is finding many ways to either pay back or keep "inline" people, businesses, cities and state governments. He has found tariffs a way to threaten various businesses - behave, support "Trump" (maybe contribute to the party, maybe let social media say anything pro Trump, etc) or face additional costs on your product (electronic companies beware!). And, yes he uses the withholding of funds (to Ukraine, cities, states) if you don't "do" exactly what he wants. Most of Trump's mean spirited ways of attacking are a detriment to "we the people" especially with increased prices and deregulation of environmental regulations and creating a tragically discouraging a united America as he encourages us to vilify one another.

Stalin also didn't like people who weren't captured: he considered Red Army soldiers captured by the Germans as traitors and had them shot or deported to Siberia upon their return home after the war. Stalin developed a cult of personality, which I'm reminded of whenever I see a Trump rally. Trump has already targeted New York and California as states who do not support him; where citizens are educated and read newspapers, they tend to oppose this authoritarian bully, In limiting the deduction for state taxes he hit the liberal states (e.g., our N.Y. and California), as the more liberal the state the more taxes it collects to provide for those without resources --to build a caring social net and good educational system for all. So Trump cuts the deductibility of these taxes. States which support him tend to care less about a social net, and tend to restrict spending for medicaid or for other other help-the-poor projects. Why is it that the more liberal states show more compassion for the afflicted, such as the migrant fleeing horrors? I think that those who are aware of the realities of life elsewhere--those who are better educated--tend to be more merciful to those facing misfortunes not of their own making. Trump is an essentially ignorant boor and it is tragic that he has been given the power he has by his Republican slaves.

I have lost count on how many times we have sued the administration, and with that in mind I thank God daily for AG Becerra. And my understanding is that New York is pretty darn good when it comes to a deserved pay-back to an undeserved, vicious, and vindictive one. That Atlantic state has taught us, its younger sister on the Pacific, well. On another note, but I believe to be equal in its revenge is the administration's final plan to allow mining and drilling at Utah's Bears Ears and Grand Staircase-Escalante National Monuments. I am not sure if this egregious plan is because of Obama or Romney. But whether it be sanctuary cities and states, environmental protection, law and justice, health care, ad infinitum, Trump is Malice defined. And New York can handle him, for sure.

Immigration law is a) federal, b) supreme to state and local law, and c) exactly what trump promised and was elected to fix, whether we like it or not. States and cities cannot nullify laws they deem insufficiently compassionate. If the democratic governor of Virginia takes similar action against the buffoonish local sheriffs in parts of that commonwealth who are declaring their counties “second amendment sanctuaries” I’ll stand foursquare behind him. And you know what? So will all the people howling about trump.

As you point out, immigration is a Federal responsibility. All we're doing in NY is allowing the Federal government to do its job and not forcing our State agencies to take on Federal jobs for which they are neither trained nor compensated. If ICE follows their own rules, and the laws of the Federal government, they have no difficulty. If they wish to circumvent laws to facilitate their process, that's a problem. Also, your comparison of the Federal/State legal relationships to a State/Municipality relationship is flawed. They are nothing alike.

The misuse of presidential power, through Trump's control of most aspects of government, to pressure Sanctuary Cities, is indeed a persecution of all New Yorkers, but more than that, it is a vindictive pursuit to search out and punish immigrants, it reminds me of the Fugitive Slave Act, in which the federal government, dominated by the southern Slave Power, enacted the Fugitive Slave Act to tie the hands of states that had made slavery against the law, by severely punishing any residents who harbored fugitive slaves. The mild-mannered philosopher, Ralph Waldo Emerson, came out slugging and said at a protest: "The fairest American fame ends in this filthy law." Of Daniel Webster, who voted for the law, Emerson said "He must learn that those ... who feel the disgrace of the new legislation creeping like a miasma into their homes and blotting the daylight ... have torn down his picture from the wall, they have thrust his speeches into the chimney." Here in our day and time we have a federal government trying to rob the freedom of enlightened people in Sanctuary Cities to make humanitarian laws that would offer some refuge to innocent people from a racist and hateful government.

Give me a break, the Editors know exactly why this limit applies to New York. Unlike other states, New York included a provision that restricted federal immigration agencies’ access to Department of Motor Vehicles records without a court order. These online system are dependent on verification and periodic re-check with the various data bases that maintain the records behind the Id's. The New York Law requires a court order for the fed's to see the records; thus making the online system unworkable for New York. residents. None of this happen today, it has been communicated previously and the State did nothing to stop the prohibition on New Yorkers from happening.

The TTP may still obtain all required information on the traveler, once the traveler gives permission to access. ICE is required to obtain a court order. This is blatant obfuscation and twisting of the consequences. Fewer hit-and-run doesn't imply safer roads because it doesn't mean fewer accidents. It simply means fewer people fleeing from the scene of an accident. Common sense says that if you add more drivers on the road (in this case illegal aliens who previously could not legally obtain licenses), then there will of course be statistically higher odds of accidents occurring. So let's say it again: fewer people fleeing an accident doesn't say anything about fewer number of accidents.

As someone who used to be undocumented, I can tell you that lacking a license isn't a deterrent because driving is sadly a necessity for work, school, and everyday life in this country. More realistically, he has seen the way to "hack" the system when you have money and don't care about what anyone except your loyalists think of you: You stonewall, you litigate, you bully. And now, with the assumed military might of the US (which he no doubt believes resides in the Republican Party), he has taken it one step further: He plays a vicious game of chicken, daring his opponents to escalate the situation, egging them on to let him unleash the military on his own people. It's landscapers, and construction guys, and house cleaners, hotel maids, busboys, and all of the other service people who happen to have been born in Mexico. Oh sure, maybe one out of 10,000 is a dangerous criminal. They get a license because without one they can't get auto insurance nor get to and from the jobs Americans don't want. Generally they're very conservative drivers because the last thing they want is to get pulled over. All of us benefit from lower insurance rates when there are fewer unlicensed, uninsured motorists. They don't jump out and run when they get in an accident. If America is going to deport every single illegal alien, that's one thing. But to punish New Yorkers for allowing those who work hard in our country a legal, safe way to get to their jobs is just wrong. Trump is about revenge, punishment, and getting even. Mercy isn't in his repertoire, nor kindness. The Bible tells us not to mistreat aliens. Maybe someone at that prayer breakfast should have reminded him.

@Wade Nelson The Syracuse Post Standard posted a story some time back about the exploitation of migrant farm workers that work Upstate NY farms. The story cited the lack of transportation that forced them to buy necessities from what resembles company stores. Transportation, where it could be obtained often cost a days wages or more. Having access to legal transportation would provide access for migrant laborers and their dependents to discounted goods at supermarkets giving them a little better quality of life. These are some of the hardest working and lowest paid workers in this country, and they are treated like forced labor. I want to believe that this and not politics is what drove NYS to implement this law.

My boarding passes are always coded with "TSA Pre-Check" going in and out of the US. I have never applied nor have I interviewed, nor have I turned over mounds of personal information, nor have I paid the government anything to go through this more efficient security line. So I assume this whole program of paid access started up just to see if it sticks. Now it's just a money-making racket for the government. The world's best airports don't do this, they properly staff the passenger lines. My guess is that Homeland Security makes a living off the program, and with New York being a popular point of entry, Trump's just going to run the deficit up even higher. He's doing it out of spite, because that's how bullies operate. I hope he looses bigly, and the Secret Service who stood on the ready when Nixon quit, will once again be on the job, ready to escort Trump out of the White House. If he refuses to go, the SS has an off-the-shelf plan that wasn't needed last time. So don't worry about that!

I am not, and have never been a liberal. In fact, I used to be a Republican, from Iowa no less. But I think Trump is a toxic, dangerous, possibly unstable man. Could even the strongest democracy survive intact after eight years of this "leader"? And it's not just the US that's in danger. Similar demagogues are following his lead in Brazil, Poland, Hungary, the UK, and more. I understand why it's in the economic or political interest for some people to support him. And there are also "low information" voters. But what about intelligent people who are too lazy to vote? The pre-check program is a convenience to travelers, but it requires that TSA have access to all records, including DMV records. If NY bars TSA access to those records, then they can’t do the necessary pre-check. And we’ll just have to endure the normal security check at airports that we have been doing since 9/11. It’s not complicated. TSA needs the DMV records for pre-check; and they don’t grant it without those records. Would you be okay boarding a plane with undocumented foreigners who have pre-check, but who got it without a proper investigation? The part I don’t understand is why New Yorkers applying for pre-check can’t grant access to TSA to their DMV records? Why make it a blanket denial for all New Yorkers?

Yet we still got vetted. Magic? No, we just apply with our passports! I can assure you that having no DMV record for ICE to check did not prevent me from being approved three times (1st time and two renewals). So, no. What you claim is factually incorrect. In fact, ICE only “needs” DMV records to establish identity when applicants choose to grant access as part of their application. No court order needed. No ICE - DMV connection otherwise.

Also, the president has previously stated clearly and multiple times that he should get more than 2 terms. The latter is the really important concern. Everything they are proposing, such as a massive public works program, is intended to garner sufficient support for more than 2 terms. And a large percentage of the taxes we pay up here in New England are sent to red states down south who don't tax their residents as much so they get federal funds. When Trump leaves office, this upcoming January I hope, he will likely never be able to set foot in New York again without a throng of protesters yelling and screaming at him. A declaration of independence would be illegal at this time, and would involve military action, but a reasonable proposal to separate could be proposed in a piece of scholarship or literature. If it takes root in the popular imagination, something could come of it. When I think of the mass moving and uprooting that would come about, not to mention the bad feelings the moves engender, I shut out the whole thought. Do we want to be like India and Pakistan? Still, we shouldn't have to live in a state of cold civil war forever. In other words, I like the idea of secession, but the logistics probably make it impossible.

These punitive actions taken by Trump underscore a reality that many of us ignored before 2016, but now must accept. Trump has no interest in representing us all. His only concerns are for his voters (a minority of the voting population, by the way). They love him for this, and this is why they're in lockstep with the most unfit president in my lifetime and I'm in my 60's. The issue not addressed here is that Trump voters and Democratic voters want two different, and incompatible versions of this country. Trump voters want a regime of soft apartheid, where their rights, as whites, are paramount over others. They believe that their "religion" should permit them to discriminate against anyone not like themselves. They believe it is just fine to shove brown skinned children into internment camps on our soil. They love a president who brags about sexually assaulting women. Trump's America is very much the America they want. Democratic voters want a very different America - a country in which all are given equal opportunities. An America that respects everyone, of every ethnic background and faith. An America that believes health care is a right for all. And an America that follows the rule of law and rejects dictators. There is no resolving this issue to everyone's satisfaction. Trump voters will continue to be the single largest voting bloc, and they will do anything to preserve what they believe is rightfully, and only, theirs. It is way past time to partition this country.

A likely explanation of Trump's singling out of New York is he seeks to intimidate and retaliate for NY state's pursuit of his tax returns. What's indisputable is democracy is in big trouble. The day after Trump was sprung by his cronies, ICE shot someone in the face in Brooklyn. It's at our front door now. We have to deal with this. Why people haven't taken to the streets like the protests in the Arab Spring, or the demonstrations in South Korea that brought down a corrupt leader, is beyond me. I know there are white supremacists who support the fascist occupant of the White House, but there are so many millions more who want to have a President we actually elected. Who want government to be by, of, and for the people. This fascist aggression cannot stand. Trump needs to be removed from office, the 52 senators who enabled his hate yesterday need to be removed from office, every judge, every ambassador, every staffer this administration has given a job, needs to be purged from the halls of government. We need public servants, not crime bosses who would render us serfs.

I don't think this will stand. Absent extremely compelling data justifying this, discriminating between citizens of states will likely be found to violate constitutional principles of federalism (equal sovereignty between states) and equal protection. See Shelby v. Holder (U.S. 2014).
