Any attempt to derail DACA is an immoral cruelly despicable act. DACA kids are Americans. They are our people. Those states attacking DACA are not worth a visit. No decent Christian should choose to live in those states and tourism should be boycotted by the masses. If necessary we must organize protests.Their state governments are armed by nasty racist. For shame!
CdRS (Chicago)
Attention Jane Blanda: DACA kids are Americans. And Obama did not destroy America. If you make statements like that you need to back them up with solid facts. Here we are now with clear air canceled, climate change disregarded, NRA supporting a president who is a sexual predator. There is proof for the things I listed above now where is your?
Salem Sage (Salem County, NJ)
Gee, I wish these six states would be equally zealous in demanding that the voting rights laws be enforced.
CdRS (Chicago)
The writer who went on about Obama’s “destruction” of America gave no facts to support any of her views. Where are the fact besides her obvious racism? She further ignored the solid and proven facts that the present congress has canceled clean air, lowered taxes only for the rich, and plans to rid the populace of Medicare and our already pathetic health system. She then forgot to mention that the present president Is waffling, indecisive, cannot hold his appointees,is being sued by the several plus women that he has betrayed his wife with, and is a proven sexual predator. These are facts that are proven!

DACA people are NOT illegals! They are innocents and represent the spirit of America. Try visiting the Statute of Liberty. Not all of us have blonde hair and blue eyes. I was born here and that it just by chance—but these people did not have that chance or even a choice. Any anti-DACA sentiment is based on prejudice—they have committed no crime and they are ours.

It seems that many of us are focused on the law. However, there are more universal moral concerns. Casting out of people who grew up with us is inhumane and unjust Remember , Christ will say to those on the left hand, ‘Depart from Me, you cursed, into the everlasting fire: for I was hungry and you gave Me no food; I was thirsty and you gave Me no drink; I was a stranger and you did not take Me in, naked and you did not clothe Me. They will answer Him, saying, ‘Lord, when did we see You hungry or thirsty or a stranger or naked or sick or in prison, and did not minister to You?’ Then He will answer them, saying, Inasmuch as you did not do it to one of the least of these, you did not do it to Me.’

It's about time. Obama's destruction of America needs to come to an end ASAP!
Just Data (Arizona)
You're exactly right. It's time to shut down any and every form of any legal status here for criminal illegals. We have millions of people waiting in line to come legally and honestly. Cut off all access to jobs, education, public resources and social services so ALL illegals have to leave to keep from starving. They can get in line from home if they care enough to come LEGALLY.

There are two very different conversations about DACA. There is the rule of law and the politics, both are challenging in a country divided. The people at risk are for the most part innocent. Their crime being entry into the country when they were children without any agency of their own with their parents. I ponder who, if any, would disregard their parents desires, not trusting them. The politics, which reflects cultural issues, is based I think on something different and sinister. The lawsuit would seem to be a cover for racial animus which should be considered a hate crime. Of course if you have enough money you can bring almost any lawsuit you want, even if its based on a particular hatred of the other. I think, in the of racist desire, the ground of those opposing DACA judges are the last stand in the face
Bill (Atlanta)
You sound like a political parrot. While I am certain there are still some people in this country with deep-seated racial hatred (of all colors and genetic backgrounds), all of the creditable studies show that your portrayal is patently false because the vast majority of people favor LEGAL immigration from Mexico and South America and actual racism continues to be in decline. When you try to twist other people's reasonable and logical desire for the rule of law into a parody of sinister and overarching evil, you make it plain to anyone who reads or hears your words your deep-seated hatred for anyone who disagrees with you politically, your despite for our country and its laws, and your petulant derision of peaceful coexistence.

Was this country ever one Nation, indivisible with liberty and justice for all? I don’t think so……just look at all of the atrocities of American history against people and what’s happening in current times. We haven’t learned from the past and I guess we never will. Many of the people against DACA forget that they too and their ancestors were at one time or another immigrants.
Bill (Atlanta)
"Was this country ever one Nation, indivisible with liberty and justice for all?" In practice? Of course not - that can only happen if we have perfect people, whatever "perfect" means. As an ideal? Mostly yes - with the added advantage that we have been at times far more loyal to that ideal than any other place on the planet. In my lifetime (60 years) our society has made great strides in overcoming the most significant injustices of my youth - and now seems bent on creating new ones to bellyache about. The rising hatred we see today is a direct result of people claiming that because that ideal was never reached we should reject the ideal and everything else associated with it. There is little new in human behavior in the 10,000 years of recorded history. Discarding the ideals which made this the most coveted place to live in the world will not make things better.
Anita (Richmond)
If Congress did their job this would not be the huge problem that is but they refuse to tackle this. This is why we need to clean house completely in Washington. Totally useless bunch of highly paid people who cannot function in the real world.

Do readers think it's merely a coincidence that when liberal blue states want to challenge anything the Trump administration does, they sue in CA or HI which are part of the liberal 9th circuit? Well now TX and other red states are suing in TX seeking a different ruling that blocks DACA nationwide. So if there are conflicting results, it will ultimately force SCOTUS to act immediately...a good thing to get this settled once and for all time.
Alex (Indiana)
This case illustrates the extraordinary dangers our democracy faces if we allow unelected Federal district court judges to, in effect, issue policy rulings that apply to the entire nation. There are over 670 district judges; some are liberal, some are conservative, and the reality is that many judges base their opinions on their own political thinking, and not on the rule of law. Thus, we will likely soon have conflicting judicial mandates, and the public officials who actually have to act will not know what to do. It is inappropriate to place officials in such positions. We are now threatened with anarchy wrought by the judiciary. One of the matters before SCOTUS in the recently heard case on the president's immigration ban concerns the limits to district judge authority. It is essential the the Court not duck this issue. My own feeling in that the matter at hand, whether or not DACA should stand, is a policy question that must be decided through our political processes, and not by solitary district judges. Personally, I think the Democratic party is right when it says repeal of DACA would constitute a "cruel anti-immigration agenda." But, while cruel to those directly affected, repeal would also send an important message to the world, that the US is a nation of laws. While those brought here illegally by their parents may suffer, which indeed may be cruel, those back home who are waiting their turn by following our laws may benefit. There is a trade-off.
Bill (Atlanta)
DACA cannot be allowed to stand as it is - even Obama was on record multiple times saying that such an action is not within the power of POTUS. Granting him the benefit of good intentions, it is up to Congress to either act to provide them permanent residency of some sort or to kick them out. But now, we are in the insane position that Judges are ordering POTUS not to discontinue an un-Constitutional executive edict. That is wrong on so many levels, and frankly should result in criminal charges of some sort for directly acting to subvert our Constitution.
Mary Melcher (Arizona)
Tremendously successful drive by the right to convince Americans that Hispanic immigrants are bad, evil people who must be feared and hated. These lawsuits make the slavering hordes of right wingers feel good--nothing else and nothing constructive or merciful.
Kathy McAdam Hahn (West Orange, New Jersey)
“Unelected federal judges are forcing the Trump administration to leave an unlawful program in place indefinitely,” Since Paxton is assigning the qualifier "unelected" to federal judges, he should be consistent and assign it to "Trump Administration" as well.
libdemtex (colorado/texas)
A bunch of ignorant fools led by paxton who should be in prison.
M (Seattle)
Good for Texas. Time to challenge the insanity of the sanctuary cities on the west coast.
Kevin K. (Jacksonville)
"Just last week, a federal judge in Washington ruled that the government must keep the program in place and start accepting applications again, unless it can provide a stronger legal justification for abandoning it." I don't believe there can be any stronger legal justification than "it's illegal." Biased much?
Robin Oh (Arizona)
We need some solid immigration reform, that much is clear. And what is so hard about getting that done? Hint: politicians. I'd love to immigrate to Australia or New Zealand, but this is not possible because I'm over the age they prefer their immigrants to be and I'm without extremely specialized skills. Obviously what these countries are doing is working for them. Isn't is possible for the U.S. to adopt some part of a similar plan that enhances our country while still providing a humanitarian allowance for families running for their lives?
Bill (Atlanta)
They'll still take you if you have enough money.
Mary Melcher (Arizona)
They cannot and will not be willing to "reform" a system that has served as a vehicle for peddling fear and hatred to the ignorant---it's their principal re-election strategy now.
Aaron (NYC)
Didn't Mitch McConnell say that the voters spoke and wanted a conservative justice on the Supreme Court as his basis for denying Obama's pick for the SCOTUS? Now federal judges aren't elected so their judgements shouldn't matter? I've never seen so many conservatives talking out of both sides of their mouths.
Bill (Atlanta)
You are confused. All of the Justices appointed under the current administration were selected to their solid adherence to the Constitution rather than political bias. The clearest evidence of this is Judge Gorsuch, who recently joined the liberal justices and voted to uphold the Constitution by striking down a law which was so vague as to be unenforceable and / or arbitrary, even though that ruling appeared to be a setback for POTUS.
Steve (Florida)
As predictable as the sun rise: grandstanding political racism. Pandering to anti-Christians is all there is in the GOP anymore.
MyjobisinIndianow (New Jersey)
This is entirely appropriate, and not unexpected. These states have threatened this for some time, which helped lead to the administration’s attempt to end DACA. It’s the flip side of New York, California, and Washington suing to keep DACA enrollments in place. I’m glad the question is being forced. The states are not challenging empathy or all the feels, they are challenging complying with an action they believe is illegal. I expect my representatives to do the same. Hopefully, this will lead to a conclusion so we can stop using DACA as an emotional bludgeon to divide us.
GBC1 (Canada)
This suit certainly raises a fair point, although the reference to "unelected judges" is disingenuous, pure theater. The US has a constitution; when requested to do so, it is the job of judges to determine whether a matter is constitutional. The judges who decide these case are federal judges:- they are appointed, not elected, in accordance with a procedure mandated by the constitution. Judges make their rulings in accordance with the law and ultimately the SCOTUS has the final say on what the law is. Surprising to have to explain this to the attorney general of a state.
miguel solanes (usa)
Independent and fair justice does not mix well with elections. Judges deciding on the basis of the next election will not be impartial. They will be subjected to the prejudices and whims of electors.
AJ (NJ)
The common ground with why States are suing the Federal Government, is weak leadership in Washington. The Republicans are in charge, yet they can't do anything except cause turmoil.
DebinOregon (Oregon)
Southern states and Republicans: A toxic combination of racial hatred, misplaced loyalty and fevered ignorance. The time, energy and public money they spend excluding some for no reason than race! And no, it's not about legality, since no one is hunting down Swedish immigrants who overstayed their visas or got a green card by marrying an American. We have forgotten the motives, hopes and efforts of our immigrant forebears! Shame.
Bill (Atlanta)
"Southern states and Republicans: A toxic combination of racial hatred, misplaced loyalty and fevered ignorance." Today's most perfect display of ignorant bigoted racist hatred. You are why people, especially independents, voted for Trump.
Talbot (New York)
So which is It? DACA was a program to defer deportation and allow young people to get on with their lives? Or it illegally granted them status and privileges the President was not authorized to grant?
Bill (Atlanta)
It was both. Reasonable people accept that President Obama was well meaning; President Obama himself acknowledge on multiple occasions that such an action would clearly be un-Constitutional. A reasonable offer of compromise (full legal residency and a path to citizenship) was offered in exchange for enforcement of our immigration laws. One party turned it down, presumably because they believe continuing the controversy advances their political agenda. No sincere person actually believes that fixing the symptom without fixing the cause is a "fair and reasonable compromise." Thus it ever was.
liberty (NYC)
I would love to hear a substantive argument why the lawsuit fails on its own merits, that DACA conferred work authorization where Congress did not.
Working Mama (New York City)
The courts need to rule on whether there was legal authority to create the DACA program in the first place before they mandate its indefinite continuance.
DebinOregon (Oregon)
Meanwhile, Republican voters need to 'rule' on why their elected representatives refused to discuss DACA when President Obama addressed the issue some time ago. When the deadline loomed, they scoffed. Now you want to know why it was enacted by executive order? Methinks FOX informed your opinion then, and still does today.
IZA (Indiana)
Gotta love how federal judges are only "activist judges" when the right doesn't get what it wants. And when I saw "seven states, led by Texas," my immediate thought was: "all southern and possibly one midwestern to mix things up a bit." Sure enough, all the usual racist suspects in play.
Alesia Stanford (San Diego)
States whose hearts have never left behind "The Confederate Cause" plus Nebraska are suing to make life more difficult for minorities. Jim Crow is alive and well.
JimNY (mineola)
Let us as a country face reality. We can no longer be one nation, indivisible. We are in the midst of a silent civil war; let's divide this country into two. There are two different visions, values, priorities. We can't deny this any longer. The current president, who thrives on dividing people, is only exasperating the situation. Places like FOX News add to the divide. Unless we find a president and congress that are able to unite us once again, we should face reality and have a peaceful separation. Sorry.
disqus (Midwest)
Tell me the compromise available between people who want a massive and intrusive Welfare State along with open borders and people who want to maintain the constitution?
Ultramayan (Texas)
The compromise is called VOTING, and in November your party will be OUT!
UN (Seattle, WA---USA)
It won’t be peaceful when the blue states refuse to give their tax dollars to these racist red states. Look at the list—with the exception of Texas—these are taker states.
DPT (Ky)
You are a bunch of people without an ounce of empathy but you show up on your appointed day at your church doors. Are you sure the golden gates are going to be opened for you?
disqus (Midwest)
It's all so wonderful to have charity when it's the federal government taking and distributing "other peoples" money isn't it? Please cite the biblical passages that state, "thou shalt establish a massive welfare state with open borders."
glenn.williams (Lincoln, NE)
Biblical passages? Why make any decisions based on the writings of ignorant, superstitious people over 2,000 years old? How about finding biblical passages that say it is OK to take over the best land, kill most of the original inhabitants and then keep it all for yourselves? Oh, yeah, I forgot how easy it is to find examples of THAT in your silly holy book...
Levy (Washington DC)
I can point it to you the places where it says, you got to clothe the naked, feed the hungry, protect the oppressed, ...in the old and new testament. Showing up at church and keeping a close heart does not make you a Piot, just a bigot. Not a sermon, just a thought
Ultramayan (Texas)
The current regime of "leadership" in Austin is an embarrassment to the citizens of Texas who have more than two operational neurons. Political hack doesn't even come close to describing this guy.
