The victim of this crime is still alive. At the very least, she deserves a public apology for how she was mistreated.

I was living in New York City at the time if this rape case, and remember how Mike McAlary of The Daily News wrote a column questioning the victim's account. Glad she has finally been proven right through DNA testing. She has been through more than enough.

Obviously Webb is a dangerous person bu often we treat people like him as criminals and believe that several years in prison will prevent or change their behavior. Hopefully we will be able to identify people who are a risk to society and find ways to deal with them besides using a justice system that is often useless and sometimes a menace.

A statute of limitations protects defendants from stale evidence and from as to amount to fabrication. Evidence discovered after the statute runs as a product of technological advance should not be barred. This seems almost axiomatic to me. A DNA test is objective evidence. It is not subject to interpretation or any one's interested memory. It is what it is and should be admissible in support of new charges. It is fortunate for society that the defendant in the Prospect Park case is in jail, but what if he weren't?

Thank you for your insightful post. It has said most eloquently what I felt boiling up inside of me when I read that charges cannot now be laid. Yours is a very sensible suggestion that surely would protect the rights of an accused as well as advance the interests of the community to be protected from such heinous crimes.

Why are there statutes of limitation for crimes like this? What about the passage of time makes a person less guilty for violence?
