Trump's hiring of his daughter and son-in-law to act as advisors should never have happened for the obvious reason that they are unqualified, having no diplomatic experience whatsoever. The fact that they are related to their boss directly through marriage is reason enough to deny them a security clearance on the grounds of mitigating potential scenarios such as kidnapping, blackmail or even assassination. The POTUS should, in future, be prohibited from employing family members and also disclose all personal assets, liabilities and tax records before taking the oath of office just so the American people can see their new POTUS isn't a fraud or a con or a tax evader. Alas, I get he feeling that if Jared were captured and held by ISIS, Trump would say, "Hey, he's a smart kid - don't worry - he'll cut a deal."

Jared and Ivanka should never have been allowed to hold positions in the White House paid or unpaid. They have no interest in public service. Their only concern is enriching themselves through their positions and connections to the president. The other major concern, especially with Kushner, is foreign entities taking advantage of and compromising him because of the highly classified information that he is privy to. He does not have the foreign policy experience or wherewithal to be in the position he is in.

Of course we always knew the kerfuffle over Hilary's emails was a scam, a cynical ploy to have something, anything, to hit Hillary over the head with. Of course we have to blame the rubes whose misogynistic rage blinded them to any rational consideration of the problem. But the media, NYT included, deserves a large share of the blame for treating the emails as a real story. Paul Waldman in the WaPo reports that “in just six days, The New York Times ran as many cover stories about Hillary Clinton’s emails as they did about all policy issues combined in the 69 days leading up to the election.” And Clinton and all the Democrats deserve much blame, as well, for not pushing back hard, calling the emails the absurd distraction that they were. Remember that hours-long interrogation that Clinton was supposed to have handled so well? She would have done better to show some steel. "This email rot is nothing but a scam, a witch hunt, and I'm not listening to another minute of it!"

It's unclear to me why rules are being bent to allow incompetent family scions to cosplay at high level government work. Ivanka has no governmental, administrative (as in Article I executive/administrative) experience or experience qualifying her to act in the capacities she purports to. As Michelle Goldberg has noted in this paper, Ivanka is unself-aware of the vast extent of her own ignorance. That she imagines herself competent to run for president is just plain embarrassing for any of us women who have actually done our homework and put in the work. Of the multiplicity of jobs/titles Jared has been given, none has borne any fruit beyond the advancement of his and his family's personal private gain. It is one thing to chalk up DJT Sr.'s ignorance to his apparent illiteracy (it's hard to learn things when you can't read). But Javanka just seem to be delusional. They imagine that intelligence is optional if your suit is well tailored and you have a good handbag. Abbe Lowell's clients are like a couple of junior high schoolers putting on a 2 person play about government.

UNSECURED emails and tweets and texts and phone messages go out from his White House every day; notably from him. Jared and Ivanka's behavior is like that of everybody else there. The NYT never gave Hillary Clinton the benefit of the doubt about her email, but is now giving Jared and Ivanka -- and everyone else in Trump's White House -- the benefit of the doubt. Apparently, the NYT believes all of them have better character than Hillary. Sure they do.

While it's easy to point to the hypocrisy of "lock her up" for Clinton's emails and overlook Javanka's, the point should be made that the right could care less about emails, on either side. They simply hated Hillary, whether for cause or bias that was what Trump hung around her neck. But doing personal business with a foreign government while in the White House is a crime his emails should become available for future prosecution, should that be warranted.

Let's not forget how the Dems were treated and the GOP unilateral investigations that were undertaken from 2016 onward. Especially, those pertaining to Hilary Clinton, and her alleged inappropriate emails. The same should be undertaken by the new House majority. The Trump administration must adhere to the same rules that the GOP used for allegations. Kushner and Ivanka must both submit for questioning, for the same reasons. They may have compromised our country in certain matters. Also, it must be ascertained whether or not they received inappropriate personal benefits for themselves and/or their families. If they fail to comply they must be subpoenaed. If they fail to appear thereafter, the matter should be submitted to the courts. They should have no more benefits than the other party was given for past years.

The government use of private email for public purposes is ubiquitous in Rep. Cummings's home state of Maryland, as he well knows. Both Democratic and Republican members of the Maryland General Assembly, Maryland's Governor, and the Maryland Association of Counties (which represents county councilors), have been adamant (behind the scenes) in preserving this status quo. It is incumbent on the press and Rep. Cummings to explain why the open government standard applying to the federal government should not also apply to state government--in this case, Maryland.

It is rather ironic that "K. T. McFarland had used a personal AOL account for official business while she served as deputy national security adviser". Using AOL e-mail violates national security policies and is a critical security exposure; the deputy national security adviser is responsible for setting national security policies and closing security exposures. All federal employees and contractor workers must complete security training as a condition of employment. This training (taken immediately upon employment) clearly mandates the use of federal e-mail systems that send mail over secure, federal networks isolated from the Internet; use of public e-mail systems is banned. AOL e-mail is not encrypted and runs over the public Internet. On the Internet, it is not difficult to intercept and read the contents of AOL e-mail (or hotmail, yahoo mail, or any other SMTP mail). For our nation's security, it is fortunate the McFarland is no longer the deputy national security adviser. By the way, as federal employees, Jared and Ivanka would have been required to have taken this security training immediately upon employment. Violating these security policies can result in penalties and/or loss of your employment.

I just finished reading Don Winslow's magnificent masterpiece "The Border," and a VERY thinly disguised Jared Kushner becomes a central figure for knowingly taking heroin money through thinly disguised banks, for a very big building on Park Street. I believe Winslow, in an extremely courageous literary move, along with a equally courageous publisher, implicates Kushner in a criminal conspiracy because he knows it's based in fact--and that if Kushner sues for liable, Kushner will be forced to testify under oath. Which is why Kushner hasn't sued. This son-in-law of our most historically corrupt president is up to his neck in financial crimes that lead back directly to fentanyl-laced heroin in American communities, says Mr Winslow, with the criminal support of international banks, and I do not doubt for an instant that this is utterly true. Kushner and his wife may be protected under the current administration, but when Trump is no longer president, he will not be protected. It is reasonable to expect, if justice prevails, that Jared Kushner will go to prison. And I will do a private little jig of joy that day.

Why do you assume that the Trumps would ever use a service that keeps backups of deleted email? I remember when Trump supporters loved Trump for his "call it how it is" and "shoot from the hip" attitude. Trump was apparently a man of the people who spoke like they did, who didn't resort to traditional political doublespeak, nor forcing his audience and analysts to read between the lines, or making them examine what he didn't say. As I read this sentence... "He argued that because Mr. Kushner took screenshots of the communications and sent them to his official White House account or the National Security Council, his client was not in violation of federal records laws." ... somehow, I sense that those same people are about to defend Trump on the grounds of nuance... the same nuance that they disparaged only a couple years ago.

@Ben It is not a nuance, what is described is perfectly legal by government rules. You can screen shot things send the image to your federal account. You can use personal email and copy your federal account. All that is required is that you keep a public record of your official government business. When you enter the realm of classified information, then things change. Sometimes you can send that encrypted over public channels, sometimes you are required to only used special internal channels.

As reported here, Kushner, Ivanka Trump, Bannon, McFarland and others have all used WhatsApp (i.e., Facebook) and other non-official messaging services for official business. This leaves me speechless. After years of Republican partisan hack hearings about Sec. Clinton's email use. After Mr. Comey played a principal role in changing the election outcome based on the FBI's own findings of innocence on her part. WhatsApp (a division of Facebook) and those other services are simply not secure. We have no way of knowing whether or not Kushner et al. are keeping proper legal records. We do however already know one thing: they are as corrupt as the day is long.

While the State Department had record retention requirements (the entire investigation was whether the deleted emails were indeed personal emails; no evidence has shown otherwise), but the State Department was not required to use government servers. The White House has both retention requirement and a requirement that work-related correspondence be done over government servers. Jared Kushner and Ivanka Trump are neither properly retaining records nor using government servers. Not the same thing at all.

And for every day afterword, for at least 600 days, the same story would have been regurgitated. Jared and Ivanka, the nepotistic newbies, consciously did this knowing it was a violation of national security. You may use private communications for federal business if you 1) keep a record of what you send and 2) do not transmit classified information that is not properly encrypted. Hillary set up her own SERVER that stored classified materials in plain text on a vulnerable network network. As well as sending out classified information encrypted. HUGE difference. The issue was not that Hillary used this setup, it is that it was used for classified information.

What is different here is that the chairman of the House committed believes that the WAY Kushner and his wife are using private messaging services fo official business may violate federal record laws. Remember that after two years of GOP and FBI investigations, it has been concluded that Hillary did NOT do anything illegal. Yet their lawyer just admitted that they are STILL engaged in the same (or even more) behavior that’s ikely violating federal law?!?! Jaren & Ivanka’s blatant prior hypocrisy — embarrassingly exposed by the media, and mercilessly mocked by late-night comedians at the time — clearly was insufficient to shame the two of them (and others in the administration, I’m sure) to change their ways. That doesn’t surprise me, given who they are, and who they work for. But I’m angered and frustrated that — after the prior public disclosure of their use of personal email for official government business — apparently NOBODY within the Trump Administration (e.g,, W.H. Counsel, FBI, DOJ, OGE, etc.) felt sufficiently empowered to actually do something to make sure that Jared & Ivanka changed their behavior going forward (i.e., to make sure that they actually follow the law!) This all demonstrates Jared & Ivanka’s lack of respect for the law, but this story is also perfect example of how anti-nepotism rules should be strictly enforced — since nobody would be willing to take any sort of action (despite the public violations of federal law) if it means going against Trump’s family members who work in the White House, since they would face the certain wrath of the petty and vindictive Trump.

I assume this will be front page news every day between now and the election in 2020. Private email use was a huge story in 2016 even though Secretary Clinton wasn't even in the White House at the time – I can only assume that given the Times' longstanding interest in these issues we'll see a steady drumbeat of reporting including many months of front page stories and skeptical questioning from journalists. In all seriousness this is an excellent opportunity to find out how gendered the coverage of Secretary Clinton was, and to see if the Times has learned its lesson about the need for 'balance' in its reporting, even where none actually exists. The Trump administration commits crimes at such an impressive clip that it must be difficult to prioritize, but with this story we have a perfect 1:1 opportunity to compare how doggedly the Times pursues this story.

@Barry Well, because what is written here is not the same as what Hillary did. You are permitted to use other methods if you keep a record of what you send. That is what the screen shot mentioned in the article does. So I could text on my normal phone, screen shot the text, send the text to my government account. No violation. As for classified information, you can sometimes send it on non-federal accounts if you have encrypted it, again sending a copy to your government account. I have worked on projects where we were allowed to send secret information via Google Mail if we encrypted it a certain way.

This paper also reported that ivanka's response was that she was unaware of this rule. So apparently ivanka did not change ? Now we are told jared is doing this also. @elizabeth forrest That is NOT the rule. The rule is that you have to keep a record. Taking a screen shot and saving it is perfectly fine. Using a personal account for business is perfectly fine. As long as you have a record that can be saved. I could use a personal google account which saves all incoming and outgoing messages, at some point they must be saved officially in the federal realm (I am not aware of any time frame).

The level of shamelessness is just like nothing we have ever seen before in American political life. Not only is there a disturbing lack of actual qualifications, multiplied by dishonesty (the bought placement at Harvard, the shakedowns of Qatar & China, the dozens of corrections to official security clearance disclosure forms), there's all this in-your-face insistence on dynastic immunity from any kind of accountability whatsoever. They just make it all up as they go along. Those suffering children being so cruelly maltreated at the border, to make this autocratic family feel... what exactly? Good about themselves? Strong? Secure? In charge of other nations? Americans, what are you allowing to be done to America?

The right thing to do would be to immediately- like in the next three minutes- suspend all IT and phone traffic to or from the WH and treat the situation for what it is: a possible compromise of highly sensitive information, possibly to foreign governments. If this were happening right now at the Pentagon, NSA, CIA or another credible agency, the doors would be locked and everyone inside would be being interrogated. And rightly so. This is beyond serious- it's a smoking gun.

Does anyone really believe that Kushner, who was just bailed out of a billion dollar debt from a foolish real estate investment by Qatari banks, is keeping and reporting everything for the public record? Kushner's father went to jail for fraud, and he married into a family who (according to the NY Times) earned their money fraudulently, but we're supposed to believe that now he is behaving in an honest and upright fashion? I don't particularly care about the method of emailing. I care a great deal about its contents. Let's hope Mueller and the NY State Attorney General have access to all of them.

Why is it that the more we learn about this Administration, the worse it gets? Not that anyone would, at this point, be surprised that it is getting worse. We can all take some hyperbole with a grain of salt. However, the upper ranks of the Republican administration are so hypocritical that they are off the proverbial charts. But you have to give them credit for their marketing and messaging prowess. And the progressives/liberals are nowhere in that league. Partly that is because of the control and power exercised by the concentration of wealth. Partly that is because the progressives/liberals cling to higher ideals, like honesty. Of course I am speaking in generalities, and their are exceptions all-round. But remember this: The Republican Party is led by a man who goes beyond punching a man when he's down; he punches a man when he's dead. We (broadly speaking) are in need of a great, great deal of luck if we are to escape this without a whole lot more damage being done. Trump likes to break the mold, to claim that he is different. I hope he's right: enough different to be the first sitting President to be indicted, convicted, and jailed.

This frustrates me every time I see a news story of some federal, state or local official conducting the people's business on private email or unsecured apps. Its not difficult to understand what communications are for work and which are personal and using the appropriate accounts for each. Electronic communications for work (especially government work) just shouldn't be conducted on personal accounts as they don't belong to the individual they belong to one's employer. The question for any government official, whether Democrat, Republican or Independent, is what are you trying to hide? If the work you are doing is above board you shouldn't have any worries about people seeing it.
