RBG's appointment to the SC is "for life." I understand the desire of the left for this lady to keep on trucking for as long as possible. But let's be honest, she is falling asleep in public, has had cancer twice, broke ribs before and just broke 3 more. She will be 86 years old in March.
It doesn't take much for someone her age to have a simple injury or cold lead to death.
These broken ribs could take 6 months to heal. Will she be able to function?
It's time for her to retire. Let her have some hobbies and time-off before she dies. Maybe she lives another decade, but I don't see her making it 2 more years on the bench.
She has had an unimaginable career. Don't let her spend her last days suffering through a full-time job at 86 years old.

Don’t forget, she has a lifetime appointment and she isn’t dead yet! I think that’s probably what the founders meant when the federal judiciary was created.

I am so sorry that Judge Ginsberg has fallen and broken three ribs. I have fallen but thankfully not broken any bones.
It might be prudent if she has some elder organization come into her office and home and see what hazards are there and get rid of them. Things like throw rugs on floors can be a hazard for older people. Unfortunately, it's also easy to fall without hazards at home or office. I like her a lot so wish her a speedy and good recovery. I agree, I think she is a tough and strong woman.

I very much admire Justice Ginsburg, but she should have retired when there was an administration that would have appointed a successor in keeping with her judicial views. She may have wanted to continue serving, but the institution of the Supreme Court, and the country, may have been better served by another Justice like Sotomayor or Kagan when there was a chance.
Should her health fails, her replacement will almost be guaranteed to stand for everything she was against, and against everything she was for.

Indeed, it is painful and as misfortune would have it, the local clinic in Harare was out of x-ray film - not surprising really, if you have been there. But the doc diagnosed it by pressing in that side which made me hit the ceiling.
I flew to Jo'berg for a better evaluation and recommendation was rest and suffer the pain for a few weeks.
And I was younger than this Justice - so good luck to her.
Now, some comments below on wishing her an eternal life etc - come on, she has every right to retire and lead her remaining years in retirement.
I think this whole ideological scale of balance has gone overboard.
Any wonder that our whole judiciary is increasingly doubted because of biases.

RBG is in great shape. My mother-in-law broke her hip at 96, had radiation for cancer at 97, and lives at home at 99, will be 100 in March. Everyone ages differently.

A few years ago I gave copies of the “Notorious RBG” to my granddaughters, not as a political gesture, but so they could learn about a woman who NEVER gave up or lost sight of her ideals and who refused, in her quiet and meticulous way, to be silenced. What a national treasure she is! Thank you, Justice Ginsburg, and please keep going!

There is alot of ageism and just plain insults in some of these comments.
I don't care if the woman is 85. Age is just a number to an extent. I know people in their 80's who put people decades younger to shame. And people in their 90's who are still kicking it hard.
I've seen up close what an unexpected injury can do. I was a caregiver to a loved one so i know what I'm talking about.
Many people who decline following an injury do so because of prejudice- as soon as you are in a hospital. after a certain age, no matter your level of fitness and mental acuity, you get treated, for the most part, in a condescending, dismissive, 'talk loud because you can't possibly understand what's being said to you ' way. it's infuriating and terrifying.
You go through a complete disruption of your routine and sleep patterns. You get power and control over your life taken from you, which is particularly frightening when you're older to endure even if reassured you're going home. You get anesthesia and painkillers.
There is some growing recognition that these things can lead to delirium, which is preventable, if handled with intelligence.
There is more to life for many in their 80's and 90's than staring at the Price is Right and those who fall into that stupor often do because the most important things have been taken from them- their identity, control over their own lives and any sense of being valued for what they gave and who they are.

I recently visited with my 102 grandmother, who is as sharp as whip, still enjoys doing NYT crosswords, and can still recall that her parents didn't like the politics of Herbert Hoover in the 1920s. In comparison, given Justice Ginsburg's agility, intellect, and mental and physical resilience at the age of 85, especially in her recovery from two bouts of cancer and other injuries, I think she'll back on the bench in no time conveying her thoughts on justice. Hundreds of millions of us wish RBG a speedy recovery. She is a treasure. Given her indomitable spirit and record of recovering from other injuries, I think she will be right back on the bench on Nov 26th.
I have an Aunt who is 85, 5' 1", and very active both mentally and physically. She drove over a curb on her bicycle and fractured a tibia. She was in one of those immobilizing casts for 4 weeks. The doctor initially thought she would need surgery just given her age but then saw how fit she was. She's doing physically therapy now, has bounced back and no one is likely to persuade her not to ride the bike again.
Just to say - recovery doesn't track so much with age as it does with physical condition, genetics, and determination. RBG is way ahead in all three categories.

I have this horrible image of her falling on glassy hard marble floors! And hope that she didn't hid her head or suffer any other injuries.
The Mayo clinic notes that, while a third of rib fractures come from events such as a fall, " 40% ... had no identifiable trauma and were likely caused by the stress of a cough, a repetitive movement like a golf swing or other nontraumatic events."
I wish for her to recover, and lament the loss of her expertise if she cannot, but fear that it will be harder this time around.
Rib fractures are generally excruciatingly painful and can lead to serious respiratory infections because it is difficult to breathe deeply. And this, coupled with her fractures in 2012, suggest her bones are quite brittle. A tough, determined little woman with a mission but a body that may not be cooperating.

I'm very discouraged by RBG's behavior. Her brilliant career as a lawyer and justice does not override her obligation to continue do the public good. She knows perfectly well that Supreme Court appointments are political in nature, but she refused to retire under Obama when she was already in her 80s and had had a bout with cancer. At age 66, I fell three weeks ago and broke my hip. The next day I endured a total hip replacement (i.e. both the ball and the socket part of the hip). Today I can walk again even without a cane (albeit slowly and carefully for another couple of weeks or so). Granted I'm twenty years younger than RBG; on the other hand she's _much_ more diligent about daily workouts and weight-bearing exercises!
Do NOT underestimate Justice Ginsburg and her determination and ability to heal and to continue to excel at her job. She's one of the most respected, motivated, and competent Supreme Court judges we've ever had, and I am so, so glad she persisted and did not retire earlier. If she had, we would have been stuck with two justices down as Trump took over instead of just one.
And just because she's in her 80's don't assume that "another medical condition" caused her fall. Like my fall, it could have been just an unlikely accident.

You are right that it is age-related in my case. I have low-level osteoporosis in my hips and that means that a fall is more likely to create a break.
But the point I was trying to make was that "another medical condition" did not cause the fall in the first place. And it certainly doesn't make one incompetent to work!

Being over 65 is an independent risk factor for falls. Nothing much you can do about that, except being aware of this and watching carefully where you are going.
I greatly admire Ginsburg but don't agree with her decision not to retire while Obama was in office (of course, before McConnell could have pulled his tricks). At 85, she's playing with fire by staying on and risking another Trump Supreme Court appointment. It seemed like a selfish decision. I think all judges should have a maximum time to serve or required retirement age.

The article stated that more details of her fall were not disclosed but I bet it had to do with a rug. It’s so easy to trip on a rug corner, especially if a person is hurrying, distracted, or tired. Oriental carpets are beautiful and complete a well appointed office or lovely home but beware of the hazard....especially if you’re not as young as you used to be.

At her age, this could be very serious. My grandfather recently fell, broke his hip and had to have surgery. He passed away from complications of the surgery (he contracted pneumonia). This all happened in less than a month - he went from being a very healthy 89 year-old to on his deathbed in less than two weeks.
Breaking any bone at 80+ is very serious. My thoughts are with RBG and her family.

I truly hope Justice G. heals quickly. I wish her the best but I'm no gambler, two years is a long time and it might be prudent for Dems to negotiate a retirement and replacement. Everyone enjoys the heady drama of the "winner takes all `merican politics" but it's really juvenile. Pragmatism and taking a strategic long-term view will win the day. I know it's a drop in a large bucket but I'll be contacting my Senators and urging that they lay groundwork for the nomination of a centrist to SCOTUS. There is too much polarization on the court, it's ugly, and the last thing I want to pin my hopes on is, respectfully, someone this old.

Who are the Dems going to "negotiate" with? The Senate -- the body that approves nominations to the SC and just rammed Kavanaugh's nomination through -- just picked up an additional 3 Republican votes. It is led by Mitch McConnell, the "leader" who refused to have hearings or a vote on the Garland nomination.
There is no chance McConnell and the Republican Senate would agree to a centrist replacement. (The only reason they might is to have RBG voluntarily to resign, and then find a reason to renege on their agreement once she did.) They have a 5-4 conservative majority on the Court as it currently stands, so they can afford to play a waiting game.

A year ago my mother, who is the same age as RBG, was in good health. Out of nowhere she had to have emergency life-saving surgery, which was followed by 2 months of in-patient rehab, and has been in assisted living since.
My take-away from my mother's unfortunate ordeal -- and the scores of seniors I've come across in these settings -- is that at RBG's age, things can change overnight.

RBG is my hero. She knows how crucial it is for her to stay on the Court. She will make it back to the SCOTUS.
People are living much longer now, especially those who take care of themselves, which she does with diet and personal trainer each day.
My 90 year old brother in law just fell (2 weeks ago), fractured a hip, had surgery, came for dinner last Saturday with my sister. He was as sharp and fit as ever, although had a temporary walker. Like RBG, he sticks to a strict diet and works out an hour each day.
Fighters like RBG will not be held back. She will prevail!

Thank goodness Justice Ginsburg did not suffer more serious damage due to this fall. Ms. Ginsburg has served her country proudly as a Supreme Court justice and should seriously consider retiring. She has been on the bench for many years and she is entitled to a well deserved rest. It is now time to bring in a younger justice who can fulfill this extremely important position.
There are many fine candidates who would make an excellent Supreme Court justice and it is time for one of them to serve our country. I wish her a speedy recovery, but the issue the NYT prefers to ignore is her declining health. Whenever I see a photo of her, it appears that she is more and more in her own world. And actuarially speaking, there is about a 25% chance of she or Brennan dying in the next two years. With the new Senate makeup (a bigger Republican majority, more Reps that are loyal to Trump), it will be easier to confirm a new judge.

My sincere best wishes to RBG for a speedy recovery and long life.
However, I am sure Diane Feinstein, Chuck Schumer, Kamala Harris, Corey Booker and other Democratic attack dogs are already scouting the list of names on Trump's Supreme Court nominee short list to find acquaintances who will allege that terrible crimes were committed by whoever is the next Republican nominee to the Supreme Court.
It didn't work with Diane Feinstein's attempt to push Dr. Blasey Ford's uncorroborated and evidence-free allegations against Brett Kavanaugh, and I am pretty sure the next Republican nominee to the Court will have to undergo a few extra FBI vettings before actually being nominated.
However, and unfortunately, it is now clear that the Democrats will do anything to try to stop a Trump nominee's confirmation. As a life-long Democrat I pains me to say this: I hope that US politics can soon regain its earlier levels of civility and respect for different opinions.

There's no mention of a number requirement for Supreme Court Justices in the Constitution. Time to 'court-pack' after Trump loses in 2020. However, several points: Harry Reid made the most moronic and shortsighted decision when he abolished the 60 vote filibuster. It's hard to believe he didn't anticipate that one day the republicans would be in the majority, and to trust McConnell at the time that it would only be for federal judges was incredibly naive and stupid. His move paved the way for the McConnell's move last year. Killing the filibuster also eliminated a way to check all other cabinet confirmations. In addition, Obama should have made Garland a recess appointment, even if it only would have been temporary. At least it would have been a response to MConnell. Had the situation been reversed, that's what McConnell would have done. Furthermore, democrats never campaign on the courts the way the republicans do. So, this is what happens. And, much as I love RBG, she really should have retired in the beginning of Obama's second term to assure a pick by him. Finally, Trump said one truth at yesterday's news conference: he knows how to fight better than the democrats, and I say this as someone who votes with the dems.

As much as I admire Ginsburg, I do feel she has been a bit selfish. Back early in 2016 out in the blogosphere I caught quite a bit of flack for morbidly suggesting she retire just-in-case a Democrat didn't win the presidency. She was 83 then and 85 now. Average life span for a woman in the US is just under 79 years.
I guess that's water under the bridge now.

According to the Social Security Life Table for 2015 (https://www.ssa.gov/oact/STATS/table4c6.html), a woman 80 years old has an average remaining life span of 9.63 years. She is over 80.5 years old now. If she survives to 81, then she will have an average remaining life span of 9.04 years - which would just clear the 90 year old mark.
These tables indicate that, on the average, an 80 year old woman has a 4.3% chance of not making it to 81, that an 81 year old woman has a 4.8% of not making to 82, and that an 82 year old woman has a 5.4% chance of not making it to 83. So, based on these averages, RBG has about a 9% chance of dying before Trump's first term is over. Should (yikes) Trump be reelected, she would have about a 30 chance of dying before the end of his second term. Of course, she might retire if she gets so frail that it is evident that she will never be able to resume her duties.
Of course RBG (like most people) has at least a couple of factors that may impact her longevity relative to "average". On the one hand she probably has access to, and takes advantage of, excellent health care. On the other hand, she has had both pancreatic cancer and colon cancer as well as having required a stent in a coronary artery.

Falls are common among seniors with increasing age. Falls among seniors often cause fractures and broken bones. My father after his 98th birthday had a fall with broken ribs and was hospitalized first in ICU and later in recovery room. Subsequently he returned home but he was not the same fit person with sharp memory any more. He barely made it to 99 but is bed ridden and unable to take care of himself or lift himself up on his own. So the after hospitalization care is very critical for Justice Ginsburg and will take a long time and while we wish her speedy recovery we have to be realistic that short of a miracle it will be difficult for RBG to be ever able to be her self again.
If she does retire and there is opening on the supreme court, I hope that the judge that will take seat has the same qualification and accomplishments as RBG when she was appointed. Most importantly one hopes that she is as independent as justice Kennedy was. Yes we strongly urge that the next appointment is a woman with an impeccable past.

The behavior of the President and his supporters is what should be called out as reckless and as dangerous to our Democracy. This man has proven to all that his motivation for his actions and behaviors to date, are driven by his personal needs above all else. He has no compunction to abuse his power as a means to gain more. He has no interest in service to his country and the people in it that he swore to protect and serve, nor does he understand what it means. To ignore his complete disregard for the truth, the rules and limits of his power and the norms of government rule, is reckless. To not demand that he serve his Presidency as it is meant and designed to be served, is reckless. He punishes those who would challenge him no matter the validity of the challenge. The rules do not apply to him in his mind. That is the definition of a dictator, not the President of the US. This holds true for those who currently abuse their positions to gain and hold power. Mitch McC's denying Obama's SCOTUS pick and the current voter suppression activity by Kemp and others are prime examples of abuses of power. These are the behaviors of of authoritarians and should be called out as reckless. Calling them out due to their kinship with dictatorial acts is our responsibility as citizens of this Democracy. However, we shall not be selfish giving her an enormous responsibility of keeping and holding the wellbeing of our democracy. It’s not her fault that that person became the president. It’s our doing. Now, we just have to deal with him, one day at a time.

Do you want to work past 85 ? Actually she is a few years retirement late. She should retire in 2014 or 2015 to give BO a chance to nominate a far left justice. She thought HRC would win and she can survive any health problem.

In many ways, Trump has been a boon to our democracy. He has clearly and unequivocally shown us two main things:
1. How many loopholes exist in our constitution. The constitution was written over 200 years ago. It needs updating to bring it in the modern world and all loopholes need closed.
2. The ugly face of American racism. It's not like Trump created this racism out of thin air. It was always there, but we kept believing that we were better than that.
The SCOTUS needs to be depoliticized. Here are a few suggestions:
- Institute 10 year term limits on every justice
- Every president gets to nominate 2 justices no more under any circumstances
- Every scotus appointment must be approved by 70% of the congress. make constitutional amendment such that both the house of representatives and the senate is able to vote on this.
- I also like the suggestion by author David Kaplan makes. For every SCOTUS case, choose a panel of judges from a circuit consisting of hundreds of judges. No lifetime or term limited appointments on SCOTUS.
These changes need to happen the next time democrats have control of the government. It will benefit everyone. We need law and justice to be impartial. The current system does not allow any impartiality. Justices have been seen as liberal or conservative for as long as SCOTUS has existed. That must end.

Maybe we need a reminder from time to time (once every couple of generations?) that the guy with the megaphone who says that he has all the answers, does not and never will. The guy who thinks he is the smartest in the room / zip code / country is not and never will be. We need a reminder that the country's original sin of racism is not yet expurgated. The constitution needs amendment to bring it into the 20th century before it's too late. That the very undemocratic and unrepresentative Senate votes on cabinet and SCOTUS appointments is ridiculous. If you look at the voting population whose Senators voted against Kavanaugh it was no contest. The senators who voted for the confirmation of Brett Kavanaugh represent 38 million fewer people than the ones who voted against him. It's absurd.

@Socrates The worship of RBG is such an odd phenomenon. Obviously her rulings are appreciated on the left and but it seems its her diminutive disposition (she's 4'11 and 85) that allows us to project a wizened, wise and Yoda-like persona to her.
The critical part of RGB myth-making is that she is blemish-free.
While Kennedy deserves far, far more credit for the Obergefell (Gay Marraige) and Casey (Abortion) decisions, he broke ideological ranks to do what was right, his true conservative rulings will never allow him hero status.
The real test of Ginsburg is when she crossed ideological lines to make the right decision; our mettle is tested when we must disappoint our followers to do what's right.

The unpleasant truth is that it can be very tough to come back from this at 85. While her mind seem sharp as ever, the fall was very likely caused by overall physical decline.
I think she should meet Trump and offer a deal if she still can. She would resign on condition that he nominates Merrick Garland to replace her. That's a win-win. She ensures that her replacement is Obama's pick. On the other side, Trump gets wins too. He gets guaranteed 3rd pick on the Court and an easy-breezy confirmation. More importantly, he gets to replace die-hard liberal with a center-left moderate. That would leave the Court at 5-1-3 ideologically. And Garland is already 66, so he's not likely to be a decades-long presence on the Court.

Justice Kennedy should be ashamed. He knew how old and fragile some of his fellow justices were. He knew what kind of man this president is. Yet he chose to retire barely a year into Trump's presidency. And all it took was a few fawning words and some professional favors by the Trump organization for his son. However, I am sure Diane Feinstein, Chuck Schumer, Kamala Harris, Corey Booker and other Democratic attack dogs are already scouting the list of names on Trump's Supreme Court nominee short list to find acquaintances who will allege that terrible crimes were committed by whoever is the next Republican nominee to the Supreme Court.
It didn't work with Diane Feinstein's attempt to push Dr. Blasey Ford's uncorroborated and evidence-free allegations against Brett Kavanaugh; besides, I am sure the next Republican nominee to the Court will have to undergo even more and deeper FBI vettings before actually being nominated.
However, and unfortunately, it is now clear that the Democrats will do anything to try to stop a Trump nominee's confirmation. As a life-long Democrat I pains me to say this: I hope that US politics can soon regain its earlier levels of civility and respect for different opinions.

Like most readers and commenters I'm concerned if she cannot continue on the court for any reason and trump gets to appoint again.
That said, its frustrating to see comments here about how she should have stepped down during Obama's tenue because it would be a wise political move - when justices are meant to be above such politics. You can't criticise the right for politicising the court but then say that RBG should have been political.

Why frustrating? It's happened multiple times in the last couple of decades. Byron White and Harry Blackmun retired in 1993 and 1994 respectively, right when Democrats had control of the presidency and Senate. That was no coincidence. Democrats lost the Senate in the November 1994 mid-terms. Ditto with Sandra Day O'Connor quitting in 2005 when the GOP had such control (before they lost the Senate in November 2006), followed by David Souter and John Paul Stevens retiring in 2009 and 2010 respectively when control of the WH and Senate had switched back to the Democrats (and it looked like Republicans would win back the Senate in 2010, though they didn't).
Writing was on the wall for Ruth Bader Ginsburg in 2013 and 2014. She could have and should have followed precedent and retired in one of those years.

I would be curious to know if all the RBG supporters on this thread know that she has commented several times that Row V Wade is a flawed precedent. It should have been decided through legislative channels and not Supreme Court. Her views.

I'm not sure you have it quite right. As I recall her views, that was her political judgment, not her legal judgment. I don't recall that she concluded that it was incorrectly decided as a matter of law. The rights to privacy and federal protections against state encroachments were established by court precedent in many cases earlier. Legal criticisms of the Roe decision involve other issues.

I think there are a lot of issues the SCOTUS wishes would have been resolved by the lower courts and through congress, but that doesn't mean they won't deal with the Buck when it comes to them.
I do recall hearing on the radio once that she speculated it might have been better if it were left to the states, but that's not the hand SCOTUS was dealt and I don't recall her regretting her vote in any way. The idea behind her comment was that as a SCOTUS issue it was politically polarizing in a way that it might not have been as a state issue. I believe she felt if left to the states it would have eventually, and more naturally, had the same long term result of making abortion legal nationwide.
I'm currently in bed curled in the fetal position....with the fate of the country in jeopardy.

Sandra Day O'Connor announced her intention to retire from the Supreme Court in 2005. Basically an anti-Earl Warren conservative, and nominated to the court by Ronald Reagan in 1981, she was 75 years old in 2005. George W. Bush was U.S. president and the Republicans controlled the Senate. But the Iraq War had turned into a debacle, and it seemed likely that Democrats would control the U.S. Senate by early 2007 following the November 2006 mid-term elections. And it also appeared likely that Bush's successor as president in 2009 would be a Democrat, by which time O'Connor would be nearly 80.
And so O'Connor strategically quit at a relatively young age for a Supreme Court justice. She's still alive at the age of 88. Recently revealing that she has dementia, I'm guessing O'Connor may be still lucid enough not to regret retiring when she did. She probably thinks her successor Samuel Alito is just perfect.
I don't think Ruth Bader Ginsburg is going to be free of such regrets when her spot on the Supreme Court is vacated.

But her husband already had Alzheimer's and was failing, so she felt she could no longer wait. In the end, her husband died before her replacement --

RBG is an inspiration professionally and personally. I want to blame her for being too proud to retire 8 years ago but she didn't know. None of us knew that this narcissistic semi-senile man-child could ever, ever...EVER be elected to the highest office in the land. Although I disagree with her political views, I do wish her -- as I would wish anybody who was elderly and had fallen like that -- a speedy recovery, and the best possible health going forward.
That said, I thought the explicitly political nature of her comments about Trump in the last few years were unacceptable. She's free, of course, to think what she wants, but Supreme Court justices should not become publicly and personally involved in politics, whether on the left or the right. It makes the general public feel that Court decisions are tainted, and that's not good. Imagine, if you will, all the justices who form the current conservative majority sitting in a row at a press conference a couple of years from now and urging voters to vote for Trump. That wouldn't be acceptable either. What she did was not far from that, and I say, shame on her.

Those of us who live in red states saw the writing on the wall--or more to the point, the billboards on the roads--and warned our compatriots in the blue enclaves to prepare for a Trump presidency. yesterday, 11 million more voters for democrat senators than republican senators and 4m for dem. house representatives than republican representatives
2 years ago, 3 million more for hillary than trump. 11 million more senate votes for democrats. i'll grant there was 1m more senate votes for republicans.
but that's it.
yet they have all 3 branches? democrats just won't realise that the republicans play to win at any cost. they'll rewrite the rules after they've won. democrats play with their own rules that they seem to think exist.

I hope that Justice Ginsburg recovers quickly and gets back to work. Nevertheless, I wish that she'd had enough of a sense of life's unpredictability to have retired six or seven years ago, when she could have been pretty much assured that President Obama would replace her with someone who represented her values. If she has to leave office in the next year, Trump will get to nominate another Kavanaugh and this time Senator McConnell won't say that we have to wait until the next election.

She is one of the strongest, most courageous women I know of. She is trying her best to stay on OUR U.S. Supreme Court bu she deserves to rest when she is ready.
She is irreplaceable but there are many qualified, Socially Conscious Women and men who will work just as hard for us. WE simply need to weather this assault on OUR democracy by The Con Don and his Robber Baron brethren, hire/elect Socially Conscious democrats and independents, increase the size of OUR U.S. Supreme Court by as many justices as it takes and pack it with progressive justices who will follow Ms. Bader-Ginsberg's example of how to SERVE on the highest court in OUR America.

@njglea: Yes, there are many socially conscious judges out there, people of good will. But as long as the nominating process is as politicized as it is, there’s no room on the Court for our kind of Justice. Donald Trump will never appoint a liberal—never mind a centrist—to the Court. And as long as Neanderthals make up the Senate majority (recall that Judge Merrick Garland wasn’t even granted the courtesy of an interview) and crocodile Mitch McConnell guards the door, there’s no way moderate judges can compete. Sad.
