The Empire State Pride Agenda that honored and praised Gov. Cuomo for this executive order seems to be ignoring the fact that when they kept "gender identity and expression" out of the state Sexual Orientation Non-Discrimination Act when they passed it in 2002, they issued an opinion by Lambda Legal Defense that transgender people were already covered under the state human rights law in the sex category. The federal EEOC ruled several years ago that gender identity discrimination was sex discrimination under Title VII. So they are praising Cuomo for something that has long been established in law and letting him off the hook for failing to use his office--as he did with the marriage equality bill in 2011--to explicitly add gender identity and expression in the human rights law. But that would require pressuring the Republican Senate or helping his own Democrats to a majority in the Senate--something he is deeply averse to.

As someone who has worked in the LGBT movement since 1974, it is wrong to say that NYS has been any kind of an "early player" in LGBT protections. Yes, a bill was introduced in 1971 to add sexual orientation to the human rights law, but it did not pass until 2002--long after other states did that. (Wisconsin was the first in 1986) We were also a laggard on passing hate crimes legislation. It took 11 years after the Howard Beach outrage to do that and it was resisted by Republicans because it included sexual orientation. Mayor Bloomberg and Attorney General Spitzer APPEALED a court order to issue marriage licenses to gay couples in 2005, defending the bigoted state law excluding us.They prevailed in the Court of Appeals and marriage equality was delayed until 2011 when Cuomo got the State Senate to pass it--the Assembly having done so five times. And New York was the last state to pass a statewide law covering only sexual orientation and not gender identity and expression in 2002. And a separate bill covering transgender people has been blocked in the Senate ever since. This "order" by Cuomo merely repeats what the EEOC and Justice Department have been holding for years--that discrimination on the basis of transgender status is sex discrimination. The federal courts and EEOC are increasingly applying that to cases of sexual orientation discrimination nationwide as well. But New York? A laggard, not a leader.

More rules and regulations for the lawyer-dominated behemoth bureaucracy known as NYS to further impose its dictates upon every aspect of our lives.
Since we no longer have any community standards for common sense and decency which would have made Cuomo's executive action unnecessary, we've become enslaved to the laws, rules and regulations coming from the endless advocacy of every special interest group.

It is sad that in the 21st century, that a political group ie the GOP, can oppose basic rights for a group of people, and more importantly, can basically side with the most intemperate people in our society, religious conservatives who want to shove their bible down everyone's throats (though I challenge any religious conservative to show me where the bible or Jesus ever said anything about transgender people), and basically the trash of all races and creeds who seem to think it is their right to hurt or otherwise deny others basic rights because "we don't like them".

Good rhetorical question. Here’s another in response. How about discrimination on the basis of age, say, when it comes to, say, compulsory years of schooling, voting, marriage, sexual consent - or do young humans not yet qualify as human beings?

It is ALWAYS good to hear that the civil rights of fellow citizens have been enlarged and protected. It is NEVER bad when members of society are allowed to live their lives as they choose so long as the rights of one don't impinge on the rights of someone else. Clearly no one is being harmed by these news protections - quite the contrary, many who currently lack protections will now have them. Good job (for a change) Governor Cuomo.

The difference being that NYS will more than likely create a whole new office and the commensurate bureaucracy to implement rules and regulations that could have been just as effectively handled under existing protections.

What this article doesn't make clear is that there is a plausible legal argument to construe the existing ban on sex discrimination as extending to discrimination because of gender identity or expression. The legal argument would be based on opinions by several federal courts of appeals construing similar language in Title VII of the Civil Rights Act of 1964 as well as a 2010 ruling by the Equal Employment Opportunity Commission construing that statute in the context of federal employment. Thus, this is not, purely speaking, a case of the Governor engaging in legislative action. Rather, it would be a case of the agency charged with enforcing the statute issuing its interpretation. It would still be up to the state courts to decide whether they accept this interpretation. Another parallel here: One house of Congress voted in 2010 to approve a federal ban on gender identity discrimination, and one house of the NY legislature has similarly voted several times to approve such a ban.
